From the report it is seen that the report has been filed by the Inspector-in-Charge, Malipanchghora Police Station, Howrah City Police, Howrah on 03.05.2025 stating that the appellant Biswa Nath Patra, S/o late Banku Behari Patra, 75, Shibogopal Banerjee Lane, PS- Malipanchghora, Dist- Howrah had expired on 13.10.2003. Photocopy of the death certificate is also annexed by the Inspector-in-Charge, Malipanchghora Police Station, Howrah City Police, District -Howrah along with the report.

As the appellant has already died, so the instant appeal stands abated against him.

The instant appeal be and the same is dismissed as abated. The appeal being CRA 41 of 2000 stands disposed of. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court at once.
