... for the Petitioners The instant application is filed under Section 482 of the Code of Criminal Procedure, 1973 praying for quashing of proceedings in connection with Complaint Case No. C-26936 of 2011 pending before the Learned Metropolitan Magistrate, 8th Court at Kolkata under Sections 418/420/406/120B of the Indian Penal Code.
Record shows that in terms of Order dated 20th August 2013 in CRR No. 4017 of 2011, this Court quashed the Complaint Case No. C-26936 of 2011.
A Special Leave Petition was preferred in the Supreme Court of India, which was disposed of in terms of the Order dated 10.04.2017 observing that order of quashing passed by the High Court would be only in respect of the Respondent accused, namely, Jagdish Singh. Report from the concerned Metropolitan Magistrate, 8th Court at Calcutta shows that Complaint Case No. C-26936 of 2011 was quashed by the said Metropolitan Magistrate by his Order dated 19.09.2013 in view
of the Order of the High Court dated 20.08.2013 passed in CRR 4017 of 2011.
In view of the conspectus of facts, passing of order as prayed for in exercise of jurisdiction of Section 482 of the Code of Criminal Procedure, becomes redundant.
Accordingly the instant application stands dismissed along with pending application, if any.
