29.02.2024 sdas rejected C.R.M.(DB) No. 432 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Para Police Station Case No. 176 of 2021 dated 24.12.2021 under Section 302 of the Indian Penal Code.

And In Re : Dhananjoy Gope .... Petitioner Mr. L. Vishal Kumar Mr. Soumosree Chatterjee Mr. Prasun Mukherjee ....for the petitioner Mr. Madhusudan Sur, learned APP Ms. Sonali Bhar ...... for the State

1. Learned Counsel for the petitioner submits he is in custody for over two years. He renews his bail prayer.

2. Learned Counsel for the State opposes the prayer for bail and submits that a number of witnesses have already been examined.

3. We have considered the materials on record. Daughterin-law of the victim lady has implicated the petitioner in her deposition. Offences, if proved, would attract mandatory life imprisonment. Under such circumstances, we are not inclined to grant bail to the petitioner.

4. The application for bail is, thus, rejected.

5. Trial court is directed to conclude the trial as expeditiously as possible preferably within one year from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
