Pursuant to an earlier order the report in the form of an affidavit has been filed by the Special Land Acquisition Officer, South 24 Parganas which is taken on record. A copy of such report has been supplied to the learned advocate for the petitioner.
It has been specifically stated in the said report that 0.17 acres of land in R.S. Plot No. 1017 and 1089 acres of land of R.S. Plot No. 1025 of Mouza Kachukhali, J.L. No. 95 under Police Station Gosaba have been acquired vide L.A. Case No. L.A.-4/33 of 2012 to 2013 for reconstruction of Aila affected embankments at Sundorban area. The report further states that notification under Section 4 of the 1894 Act was published in the Kolkata Gazette Extraordinary on 13th February, 2013 and declaration
under Section 6 of the said Act was published on 19th March, 2015. Award was also declared and the names of the person in his favour the award has been declared has been specifically stated in the said report. The report also states that R.S. Plot No. 1023 is not involved in any land acquisition case. The petitioner claims compensation in respect of Plot No. 1017, 1023 and 1025.
From the documents annexed to the report it is evident that out of the aforesaid 3 plots, two of such plots have been acquired, award has been published and compensation amount has been determined and some of the awardees have also received the compensation money. Any dispute either with regard to entitlement or apportionment of compensation has to be raised in the manner as provided under the relevant statute and cannot be decided in this writ petition.
Accordingly the writ petition stands disposed of. It will be open to the petitioner to take appropriate steps in accordance with law.
There shall be however no order as to costs.
