Petitioner has assailed order granting anticipatory bail on the ground opposite party no.2 had undertaken to pay Rs.50,000/- per month as maintenance allowance.

It is trite law condition directing payment of maintenance allowance cannot be imposed on an accused while granting pre-arrest bail. Non-compliance of such direction, in our estimation, would not justify cancellation of anticipatory bail1.
