It is submitted by the Advocate appearing on behalf of the State respondent that in terms of a notice dated 14.12.2016 the Collector has issued appropriate notices to the petitioners inviting the petitioners to come and accept the compensation. It is further submitted on behalf of the State-respondents that there are private disputes by and between the petitioners and the co-sharers as to who is entitled to receive the compensation.
Heard the parties.
In view of the submissions made on behalf of the parties, I am of the view that the instant writ petition is not maintainable since there are disputed questions of fact as to entitlement of compensation which are of a civil nature cannot be ordinarily decided by the Writ Court.
In view of the aforesaid, W.P. 2000 of 2019 is dismissed.
Liberty is granted to the petitioners to initiate appropriate proceeding in accordance with law for release of compensation.
