The petitioner alleges that the Juranpur Gram Panchayat and the tender committee had granted work orders in respect of various tenders of their favourit persons. A list of successful bidders has been produced before the Court to demonstrate that one person had been granted eleven work orders, whereas others had been deprived. These are disputed questions of facts, which cannot be decided by a writ Court. There is nothing on record to show that a person if eligible, could not be granted more than one work. No reference has been made to the notices inviting tender. Whether the clauses in the said notices prevented participation of a bidder in more than one work is not before the court.

Under such circumstances, the writ petition is disposed of granting liberty to the petitioner to approach the Block Development Officer, Kaliganj Development Block with his allegation. If such approach is made, the same shall be disposed of in accordance with law, upon hearing the

petitioner, the authorities of the Juranpur Gram Panchayat, who are involved with the tendering process and also those persons against whom the allegations have been made in this regard.

It is made clear that in the representation, specific instances and details with regard to the allegations against the third parties shall be narrated. Vague and omnibus allegation shall not be entertained.

The entire exercise shall be completed within a period of four months from date of receipt of the representation. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
