The petitioner is the appellant of the title appeal being Title Appeal No. 21 of 2019. The said appeal was filed out of time, as such, the appellant has filed an application under Section 5 of the Limitation Act, praying for condonation of delay.

The petitioner prays for a direction upon the Appeal Court below for expeditious disposal of the said application.

It appears from the record that the learned Appeal Court below has already fixed February 09, 2021 as the next date for hearing of the said application.

In view of such, no direction as prayed for is warranted.

C.O.245 of 2021 is disposed with the above terms.

There shall be no order for costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
