Mr. Jyoti Prakash Chatterjee Ms. Sukanya Datta ... for the State - respondent(s) The petitioner is aggrieved by the fact that in spite of informing Inspector-in-charge/officer-in-charge of Minakhan police station, no steps have been taken by him for the last two years and the respondent nos. 9 to 13 by showing their dominance over the area are preventing the petitioners from peaceful enjoyment of their property and the same is in spite of the petitioners having an order from the learned Civil Court.

Mr.

Datta, learned advocate,

appears on behalf of the State and submits that since the information were furnished in the year 2023, it is too late in the day, to assess regarding the ground reality existing over there.

The petitioners have enclosed number of injury reports along with writ petition.

Let a copy of the complaint along with the present resistance foisted upon the petitioners be placed before the superior officer of the police - be it, either SDPO and/or DSP-in-charge of Minakhan Police Station.

The concerned superior officer of police will assess regarding the order passed by the learned civil court, injury reports which are in the possession of the petitioners as well as whether petitioners are facing any resistance from enjoying their property.

If any fresh application is filed

before the concerned superior officer of police, the concerned superior officer would take steps in accordance with law preferably within a period of four weeks from the date of the application being forwarded before police officer concerned.

In meantime, police authorities would keep a strict vigil and ensure that no breach of the peace and tranquility takes place as also no untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations, WPA 2980 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.
