NB 18.07.2022 CRR 165 of 2016 Ct. No. 33 In Re:- An application under Sections 397/401 read with Section 482 of the Code of Criminal Procedure, 1973.

In the matter of:- Ajit Kumar Agarwala ...petitioner None appears on behalf of the petitioner.

The present revisional application has been filed challenging an order dated 11.06.2016 passed by the learned Sub-Divisional Magistrate, Darjeeling in MR. Case No.01/16 under Section 144 of the Code of Criminal Procedure.

It appears that the impugned order under challenge was passed on 11.01.2016. As per Section 144(4) of the Criminal Procedure Code no order under section shall remain in force for more than two months from the date of making thereof. Thus, as it is found that the two months has elapsed, the present revisional application has become infructuous and accordingly stands dismissed.

All connected applications, if any, shall stand disposed of. Interim order, if any, shall stand vacated.

Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
