Matter relates to transfer of the petitioner based on application made on Utsashree Portal for his transfer since child of the petitioner is suffering from ailment. School authority where petitioner is presently working forwarded the transfer application on 16th February, 2022 to the concerned District Inspector of Schools (SE) for taking further steps. The District Inspector of Schools (SE) in his turn has processed the transfer application and forwarded the same to the West Bengal Central School Service Commission for taking final decision on 18th February, 2022. Grievance of the petitioner is in
spite of receipt of transfer application on 18th February, 2022 till date no decision has been taken.
Respondents are represented by learned advocates who have jointly submitted that due to suspension of Utsashree Portal with effect from 29th September, 2022 transfer application of the petitioner could not be considered.
On behalf of the Commission it is submitted that if concerned authority is directed transfer application shall be decided in accordance with law.
Having considered the submissions made on behalf of the parties writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no. 3 to decide transfer application of the petitioner by 4 (four) weeks from the date of communication of this order and decision to be communicated to the petitioner by 7 (seven) days thereafter.
It is made clear that transfer application of the petitioner shall not be rejected on the ground of suspension of portal There shall be no order as to costs.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
