A direction to secure expeditious disposal of interlocutory application dated 22.12.2018, filed by the petitioner, seeking permission to raise construction for residential house has been sought for, upon resorting to Article 227 of the Constitution of India.
Upon perusal of the photocopy of the order sheet annexed with the instant revisional application, it appears that there are three interlocutory applications dated 28.11.2017, 16.02.2018 and 12.12.2018 awaiting decision to be rendered by the learned Court below.
The reference of interlocutory applications filed by the petitioner is thus conspicuously absent in the order dated 22.01.2022.
In view of the nature of the order proposed to be made, service of this application upon the opposite parties is considered to be not necessary. Service of notice upon opposite parties is thus dispensed with. Learned Civil Judge (Senior Division) Diamond Harbour, South 24 Parganas in connection with Tittle
suit No.97 of 2015 is directed to ensure expeditious disposal of interlocutory application, dated 22.12.2018 filed by the petitioner, along with three other interlocutory applications, mentioned hereinabove, on the date already fixed for the purpose, i.e. 17.06.2022, and if any reasons whatsoever, the same could not be taken up by the learned Court below, all such interlocutory applications may be disposed of within eight weeks thereafter peremptorily, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.
With this direction and observation, the revisional application is disposed of.
There shall be no order as to costs.
