Learned advocate appearing for the petitioner submits that petitioner is in custody for 424 days and till date charge has been framed but the witness action has not commenced. Learned advocate for the State opposes the prayer for bail and submits that the subject matter of recovery in the present case is about 33 Kgs. of Ganja.

Having considered the quantum of recovery and that Section 37 of the NDPS Act is attracted, I am not inclined to release the petitioner on bail. However, State is directed to take effective steps for progress of the trial of the case. At this stage, CRM (NDPS) 290 of 2026 is dismissed.
