Petitioner is directed to serve a copy of the revisional application upon Mr. Santanu Deb Roy, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioner submits that the warrant of arrest was issued against the petitioner on 20th January, 2023 and the petitioner apprehends that he may be taken into custody in case he appears/surrenders before the learned ACJM, Haldia.

The case is under Sections 302/307/326 of the Indian Penal Code. In case the petitioner appears/surrenders before the learned court and the learned court from the records finds that the petitioner was earlier on bail, then in that case, learned ACJM, Haldia will allow the petitioner to continue on the same bail and bond with such conditions that further appearance before the court is ensured in future. The petitioner would surrender by 30th June, 2023. The execution of warrant of arrest be stayed till 1st July,

2023. Learned ACJM, Haldia would revive the warrant of arrest on 3rd July, 2023 and proceed to the next harsher process of law in case the petitioner do not appear/surrender within the aforesaid prayer.

With the aforesaid observations, CRR 448 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
