Mr. Ayan Poddar Mr. Ayan Dutta Ms. Poulam Bhowmick .....For the Petitioners Petitioners are apprehensive regarding the warrant of arrest issued by the learned Metropolitan Magistrate, 13th Court, Calcutta by its order dated 10.01.2023.

In view of the nature of the proceedings complained of, I direct that in case the petitioners either physically appear or is represented through a learned advocate by way of filing an application under Section 205 of the Code of Criminal Procedure before the learned Metropolitan Magistrate, 13th Court, Calcutta on or before 24th February, 2023, the learned Magistrate would recall the warrant of arrest which was issued. In the meantime, the warrant of arrest which has been issued on 10.01.2023 be stayed till 28th February, 2023. If there is non-compliance on the part of the petitioners, the learned Magistrate will proceed to the next harsher process of law on and from 1st March, 2023. As prayed for, petitioners would be at liberty to take recourse and file afresh in respect of the proceedings at a subsequent stage. With the aforesaid observations, C.R.R. 450 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court.
