The State of West Bengal Mr. Pronojit Roy ...for the petitioner Mr. Prasun Kumar Datta, APP Mr. Subrata Roy ...for the State Vide order dated 23rd February, 2022 this Court called for a report from the Investigating Officer of this case regarding the genuineness of the documents filed by the petitioner to prove her citizenship.

The Officer-in-charge of Bagdah Police Station submitted a report stating, inter alia, that Namita Biswas, the petitioner herein, is a permanent resident of village Santra within P.S. Chakdaha for a long time. She is a bona fide voter of the Chakdaha Assembly Constituency. However, the

authenticity of the Aadhaar Card has not been collected by the Investigating Officer in spite of his effort.

Since the report submitted by the Officer-incharge of Bagdah P.S. states that the petitioner is a permanent resident of a village within P.S. Chakdaha, I am inclined to release the petitioner on bail.

The petitioner is enlarged on bail of Rs.10,000/- with one surety of like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Bongaon, North 24 Parganas.

The application is, thus, disposed of.
