Learned counsel for the petitioner contends that, despite the petitioner having applied for a new electric connection at his premises, which is a multi-storied building, the WBSEDCL has not yet given such connection.

Learned counsel appearing for the WBSEDCL contends that for giving the new connection to the petitioner, additional load will be required, for which an additional sub-station/transformer has to be installed at the vicinity alongside or near the existing transformer. However, the WBSEDCL has been facing obstruction from some local people whenever they attempted to install such sub-station/transformer at the locality.

Moreover, learned counsel for the WBSEDCL contends that the petitioner is already enjoying electric connection of a lower connected load service connection from the existing transformer, contrary to the contention of the petitioner that he is not enjoying any electricity at present.

Be that as it may, since the petitioner has applied for a new electric connection requiring additional load, which necessitates a higher connected load service, there is no impediment on the part of the WBSEDCL otherwise to give such connection to the petitioner, subject to disconnection of the existing/earlier electric supply enjoyed by the petitioner at the same premises as per the extant practice.

Accordingly, WPA 2922 of 2022 is disposed of by directing the WBSEDCL to take necessary steps, including the installation of a new substation/transformer at the locality and to give a new electric connection as applied for by the petitioner, of a higher load, upon disconnection of the previous supply to the petitioner, of course, subject to compliance of all formalities by the petitioner.

In the event the WBSEDCL personnel face any obstruction from any quarter, it will be open to the said personnel to approach the respondent no.3, the Officerin-Charge of the Tamluk Police Station for adequate police assistance.

If so approached, the respondent no.3 shall act on a server copy of this order and immediately provide adequate police assistance to the WBSEDCL personnel at the cost of the petitioner.

It is made clear that since no affidavits have been invited, both parties are deemed to deny each other's allegations.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
