Ms. Sreyashee Biswas Ms. Puja Goswami ... for the petitioner Learned advocate appearing for the petitioner prays for expediting the proceeding being Misc. Case No.39 of 2017 under Section 12 of the PWDV Act, 2005 pending before the learned Additional Chief Judicial Magistrate, Paschim Burdwan. Record of the revisional application reflects that the complaint is under the provisions of PWDV Act which has been pending for various reasons.

According to the learned advocate appearing for the petitioner the husband has been complying with the order of interim maintenance so passed by the learned trial court and affirmed by the revisional court.

Learned advocate emphatically submits that the husband intends to adduce evidence in support of its case and as such, until and unless the trial is progressed, he will be seriously prejudiced.

Having regard to the submissions made by the learned advocate appearing for the petitioner and the fact that the case was initiated in the year 2017, I direct the learned trial court to fix at least one date in every sixty days, so that the trial of the case

can be taken to its logical conclusion within a reasonable period of time. The learned court would take steps for ensuring the presence of the witnesses on the date so fixed.

With the aforesaid observations CRR 498 of 2022 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
