In obedience to the order dated 20.03.2023, the appellant Ujjal Mondal is produced by O.C, Manikpur IC, HPC in Court today. Mr. Tanmay Kr. Ghosh, learned Senior Government Advocate being assisted by Md. Kutubuddin, learned Counsel are also present in Court for the State. On thorough questioning, the appellant Ujjal Mondal submits that as he has already suffered the sentence and he has been bestowed with the benefit of remission by the State, he does not want to proceed any further in the appeal. We have appointed Ms. Sulagna Sarkar, learned Counsel to have thorough discussion with the appellant about the pros and cons of not proceeding in the appeal any further. Ms. Sarkar, learned Counsel after thorough discussion with the appellant, Ujjal Mondal in strict confidentiality, making him understand the consequence and benefit, submits that she is satisfied that the appellant does not want to proceed any further in the appeal.

In view of such development, we dispose of the appeal being CRA 82 of 2004 as withdrawn. The appellant who is in the Court today is directed to file a memorandum to the effect that he wants to withdraw the appeal. The Secretary, Calcutta

High Court Legal Services Committee is directed to pay fees of Rs. 2,000/- to Ms. Sulagna Sarkar, learned Counsel for her service rendered to the Court in the matter.

The memo filed by the appellant be taken on record. The Department is directed to send down the record to the learned trial court along with a copy of this order. Personal appearance of O.C Manikpur IC, HPC and the appellant, Ujjal Mondal is dispensed with.

A free copy of this order be supplied to Ms. Sarkar, learned Counsel.
