Petitioner is directed to serve a copy of the revisional application upon Mr. Koushik Kundu, learned Advocate, who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned authorities in due course. Mr. Chatterjee, learned advocate, appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in the instant case and has been victim of the circumstances.

According to the learned advocate, the petitioner was nowhere in the periphery where the alleged incident took place and the police authorities have implicated both the parties by way of case and counter-case. The petitioner has already received the copies under Section 207 of the Code of Criminal Procedure. Learned advocate for the petitioner intends to his get case assessed by the learned jurisdictional court. Accordingly, if an application under Section 239 of the Cr.P.C is preferred before the learned

Magistrate who is in seisin of the trial of the case, the learned Magistrate will consider the same in accordance with law and without being influenced by any observations of this court while disposing the present revisional application. With the aforesaid observations, the revisional application being CRR 451 of 2023 is disposed of.
