For the State Mr. Ratul Biswas ..... for the Board The petitioner is a TET, 2014 qualified Court No. 24 23.12.2021 (Item No. 17) (AB) empanelled but untrained candidate. Her documents relating to Higher Secondary Marks sheet acquired from Jharkhand Academic Council was sent for verification. The same after verification reached the Board on 29th August, 2018.
Due to the restriction imposed by the Ministry of Human Resource Development, Department of Literacy requiring appointment of only trained teachers beyond 10th August, 2017, the prayer of the petitioner for being appointed was forwarded by the Board to the School Education Department. The Board intimated that her status of remaining "withheld" shall be withdrawn after clearance of the Department of School Education is obtained.
According to the petitioner, no intimation has been served upon her with regard to the decision
taken by the Department of School Education till date.
Learned advocate representing the Department of School Education does not have any instruction in the matter.
As it appears that the matter is pending consideration at the end of the Department of School Education for a considerable period of time, accordingly, the instant writ petition is disposed of by directing the Secretary, Department of School Education to take a decision with regard to the prayer of the petitioner for being appointed at the earliest, but positively within a period of five weeks from the date of communication of a copy of this order. The petitioner is directed to forward a copy of the communication dated 27th December, 2019 by the West Bengal Board of Primary Education to the aforesaid respondent at the time of communicating the order of this Court.
The writ petition stands disposed of.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
