We have considered the materials on record. Members of the BSF party intercepted smugglers who were transporting narcotics across international border. Petitioner fled from the spot. Narcotics above commercial quantity i.e. 741 bottles of phensedyl syrup were seized. Co-accused were arrested. Petitioner had absconded and has not cooperated with investigation. He contends he was in Bangalore for medical treatment. No document in support of the plea is placed on record.

Under such circumstances and in view of the gravity of offence involving illegal transportation of narcotics above commercial quantity attracting restrictions under Section 37 of NDPS Act, we are not inclined to grant anticipatory bail to the petitioner.
