Learned advocate appearing for the petitioner submits that the private-respondents have been duly served.
In spite of service, none appears to represent the private-respondents.
State is represented by its learned advocates. Petitioner claims to be the owner of Plot Nos. 312 and 313, Mouza - Tildaganga, JL No. 235 under Pingla Police Station in the district of Paschim Medinipur. Petitioner states that a PWD road is running adjacent to the aforesaid property of the
petitioner and, alleging encroachment upon the PWD road the petitioner submitted a representation before the Executive Engineer, Midnapore Highway Division, Public Works (Road) Directorate, Public Works Department.
Learned advocate appearing for the petitioner submits that the Assistant Engineer, Kelghai Bridge Highway Sub-Division, PW (Roads) Directorate, Public Works Department issued a notice under Section 10(1) of the West Bengal Highways Act, 1964 directing the encroachers to remove the encroachment within seven days from the date of receipt of the said letter. Learned advocate appearing for the petitioner submits that the encroachment has not yet been removed and the respondent authorities are sitting tight over the matter.
Learned advocate appearing for the State submits that consequential steps in accordance with law shall be taken by the respondent authorities. In the event the directions contained in the notice under Section 10(1) of the West Bengal Highways Act dated November 24, 2025 has not yet been complied with by the encroachers, the respondent authorities are directed to take consequential steps thereafter in the light of the
provisions laid down under sub-Sections (2) and (3) of the 1964 Act in accordance with law and to complete the entire exercise as expeditiously as possible but positively within a period of six weeks from the date of receipt of a server copy of this order.
With the above observations and directions, this writ petition stands disposed of.
