The appeal arises out of an order of acquittal passed by the learned 10th Metropolitan Magistrate, Calcutta, under Section 248(1) of the Criminal Procedure Code. The appellant has filed a written instruction before the Court stating that he does not want to proceed any further with the hearing of the present Criminal Appeal. Let the same be kept on record.

Under such circumstances, the instant Criminal Appeal is dismissed for non-prosecution.
