Petitioner is the brother-in-law of the deceased wife. He did not reside at her matrimonial home. He has been falsely implicated out of grudge. Accordingly, he prays for anticipatory bail.

Learned Advocate for the State submits victim-wife was subject to cruelty over demand of dowry by the husband and inlaws including the petitioner. She committed suicide within two years of marriage.

We have considered the materials on record. Petitioner is the brother-in-law of the victim lady. He resided separately from the couple. Allegations of torture levelled against him are general and omnibus.
Custodial interrogation for progress of investigation is not necessary and petitioner may be granted anticipatory bail.

Accordingly, we direct that in the event of arrest, the petitioner viz., Sudip Kar @ Chanchal Kar be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. He shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
