This revisional application has been filed challenging an order dated January 17, 2020 passed by the learned Sessions Judge, Alipore, South 24 Parganas in Criminal Motion No 255 of 2019. It is understood from the order under challenge that the petitioner had not taken any step in the Criminal Motion No. 265 of 2019 before the learned Appeal Court. So the stay of the proceeding granted in favour of the petitioner was vacated and the Criminal Motion was dismissed for nonprosecution. Against such order, the petitioner has preferred this revision. But the conduct of the petitioner speaks of dismal conduct. On the last occasion on December 10, 2020, one Mr. Hirak Roy, learned Advocate submitted that the parties have compromised the matter. Accordingly, the petitioner was not eager to proceed with the case. Since Mr.
Roy is not the Advocate on record and since there is no written instruction filed in the matter, this Court wanted to ascertain from the Advocate on Record, namely Mr. Siddhartha Sarkar about the compromise between the parties. Since none has turned up, let the revisional application be dismissed for default. (Shivakant Prasad, J.)
