In spite of service, none appears for the privaterespondents. State is represented by its learned advocates. Petitioner claims to be the owner of Plot No. 2010 within Mouza - Hatisal, JL No. 51 under Panskura Police Station in the district of Purba Medinipur. Petitioner states that a PWD road is running adjacent to the aforesaid property of the petitioner. Petitioner further alleges that the privaterespondents have raised an unauthorized construction by encroaching upon the PWD road.
Petitioner submitted a representation dated October 14, 2025 before various authorities including the concerned Assistant Engineer. Petitioner submits that in spite of receipt of such representation, no steps have been taken by the respondent authority till date.
Mr. Bihani, learned Senior Advocate appearing for the State submits that upon receipt of the said representation the concerned Assistant Engineer, Public Works Directorate has requested the concerned Block Land and Land Reforms Officer to demarcate the plots n question and to submit a report along with a sketch map indicating as to whether there is any encroachment upon the PWD road. He, however, submits that the work of demarcation is yet to be completed.
In the light of the submissions made by the learned advocates appearing for the respective parties, this writ petition stands disposed of with the following directions:
i) The Block Land and Land Reforms Officer, being the 6th respondent, is directed to carry out the work of demarcation of the aforesaid plot in question and to prepare a report along with a sketch map showing specifically as to
whether any portion of the PWD road has been encroached upon.
ii) Needless to mention that the entire work of demarcation shall have to be carried out by the 6th respondent upon prior service of notice to the petitioner, private-respondents or any other person who may be affected by such demarcation.
iii) The work of demarcation shall be completed as expeditiously as possible but positively within a period of four weeks from the receipt of a server copy of this order.
iv) The report along with the sketch map shall be forwarded by the Block Land and Land Reforms Officer, Panskura-I, being the 6th respondent, to the petitioner, privaterespondents or any other affected party as well as upon the Assistant Engineer, Public Works Directorate, Tamluk Sub-Division, being the 3rd respondent within the time limit as indicated hereinbefore.
v) Immediately upon receipt of the said report if any encroachment upon the PWD road is found, necessary proceeding in accordance with Section 10 of the West Bengal Highways
Act, 1964 shall be initiated by the respondent no. 3 and the entire exercise under the said provision shall be completed as expeditiously as possible but positively within a period of six weeks from the receipt of a copy of the report from the concerned Block Land and Land Reforms Officer.
