-------- In Re : Application for Special Leave to Appeal under Section 378(3) of the Code of Criminal Procedure, filed on 29th January, 2018. This is an application for Special Leave to Appeal against the judgment and order of acquittal dated 30th November, 2017 passed by the learned Judicial Magistrate, 2nd Court at Sealdah in Complaint Case No. 104 of 2012 thereby acquitting the opposite party no.1 from the charge under Section 138 of the Negotiable Instrument Act.

None moves the application. The application is pending since 2018. Four years have lapsed. Therefore, this Court has every reason to hold that the applicant is not willing to proceed with the instant application.

Accordingly, the application under Section 378(3) of the Code of Criminal Procedure is rejected.
