Cat. - I Mazdoor (UG), U.M. No.196594 with the Eastern Coalfields Limited. He was appointed on 15th December, 2010. He died on 11th November, 2016.

The petitioner applied on 2nd April, for compassionate employment in place and stead of her husband. Since the deceased did not register his wife's name with the Eastern Coalfields Limited, the petitioner's prayer was rejected by communication dated 7th April, 2017. Learned counsel for the Eastern Coalfields Limited in usual fairness submits that notwithstanding the petitioner's name not having been entered in the records of the Eastern Coalfields Limited, a fact finding committee comprising of three persons had infact caused enquiries into the claims of the petitioner and their initial report was not found satisfactory. The said fact finding committee is in the process of conducting a further inspection.

It is, therefore, ordered that the fact finding committee shall complete the enquiry into the claims of the petitioner and shall also consider the documents filed by the petitioner along with the writ application.

Let the committee submit a report mandatorily and positively within a period of two months from date to the concerned authority and the Eastern Coalfields Limited may take a suitable decision on the basis of such report and the documents annexed with the writ application within a period of one month thereafter.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
