(M) 427 of 2026 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kaliganj Police Station Case No. 242 of 2022 dated 22.04.2022 under Sections 341/326/307/302/34 of the Indian Penal Code, 1860 read with Sections 3/4 of Explosive Substances Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 3 years 6 months and only five witnesses have been examined out of 42 witnesses cited by the prosecution. Learned advocate has also drawn the attention of the Court to the orders passed in CRM(DB) 3116 of 2024, CRM(DB) 4014 of 2024 along with the bail orders of other accused persons.

Learned advocate appearing for the State in spite of opposing the prayer for bail is unable to distinguish the locus of the present petitioner from that of the other accused who have been released on bail.

Having regard to the totality of the circumstances and the period of detention of the petitioner, I am of the view that further detention of the present petitioner in connection with

the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Tachu @ Kachuruddin Sk shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Nadia at Krishnagar.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Trial Court and shall not leave the jurisdiction of the district of Nadia without prior permission of the learned Trial Court. The application for bail, being CRM (M) 427 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
