Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner's mother was an employee of the SAIL. There was a disciplinary proceeding started against her and she was given a minor penalty. She was arrested in connection with the present case and was thereafter granted bail. The only allegation against the present petitioner is that being the son of the co-accused mother, he received a sum of Rs.5 lakhs and odd of tainted money in his account. From the supplementary affidavit, it appears that the petitioner has, without prejudice, paid back the alleged sum of money that had fraudulently come to the petitioner's bank account.

Learned Additional Public Prosecutor strongly opposes the prayer for anticipatory bail. He submits that a total sum of Rs. 33 crores meant for 142 employees of the Durgapur Steel Plant was taken out illegally by means of 185 transactions and the money was transferred into several bank accounts including that of the present petitioner. The principal co-accused have been arrested. Considering the above, the other materials available in the case diary, the alleged role ascribed to the present petitioner, the fact that the principal accused were arrested in connection with this case and the fact that the petitioner has returned, without prejudice, the money that had come to his account and the fact that charge sheet has been submitted, I am inclined to grant anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall surrender before the learned jurisdictional Court and pray for bail within four weeks from this date and shall attend the jurisdictional Court regularly. The petitioner shall not threaten or intimidate the witnesses.
