G.G.Dalmia & ANR. v. State
20.12.2022 1_3 SB Ct. No.236 CRR 3784 of 2006 with CRR 305 of 2007 with CRR 308 of 2007 Mr. Milon Mukherjee, Sr. Adv.
Mr. Biswajit Manna Mr. Smartajit Sarkar ... for the petitioner Mr. Shiv Chandra Prasad ... for O.P. No. 2 Office report indicates that the order dated 30.11.2022 was passed in respect of 'C.R.R. 305 of 2008' whereas it should be 'C.R.R. 305 of 2007'.
The petitioner preferred the application for criminal revision for quashing of the proceeding before the learned Trial Court in terms of the settlement arrived at before the Hon'ble Apex Court by the parties. However, inadvertently, it was observed that 'Under such circumstances, all the revisional application are denued of any merit and are dismissed' whereas it should be 'Under such circumstances, the proceeding before the learned Trial Court are denued of merit and should be quashed.'
This error apparent on record requires necessary corrections which I accordingly do.
Let the criminal revisions be allowed consequent upon which the proceeding before the learned Trial Court stands quashed. The inadvertent typographical errors are hereby corrected of the order dated 30.11.2022 shall always be read conjointly with this order.
The server copy may also be corrected accordingly.
Urgent Photostat certified copy of this order, if applied for, be supplied to the parties, upon completion of requisite formalities. (Siddhartha Roy Chowdhury, J.)
