16.09.2022.

Court No.13 Item No. 34 pk W.P.A. No. 2966 of 2022 With CAN 1 of 2022 Sailes Chandra Das

Versus

State of West Bengal & Ors.

Mr. Jayanta Mitra ...For the petitioner.

Mr. Subhabrata Datta, Mr. Banibrata Datta ... For the State.

In Re: CAN 1 of 2022 (Restoration) Despite service of notice, private respondents are not represented.

Sufficient grounds are available to explain the absence of the petitioner and/or his Counsel on 10.06.2022.

The said order is recalled and the writ petition is restored to its original file and number.

Accordingly, CAN 1 of 2022 is disposed of.

There will be, however, no order as to costs. In Re: W.P.A No. 2966 of 2022 The writ petitioner is aggrieved that the Pandua Police Station has not taken any steps despite complaint dated 18.01.2022 filed by the Nivedita Sishu Siksha Kendra. The teachers of the said Nivedita Sishu Siksha Kendra also have made diverse allegations against one Rana Chowdhury and certain other persons.

Proceedings under Section 107 of the Cr. P. C. against NCR No. 97 of 2022 have been taken out by the Pandua Police Station.

Having considered the documents on record and the complaint itself, this Court is of the view that the dispute is purely civil and private in nature. The Officer-in-Charge, Pandua Police Station shall, however, call the said persons named in the complaint and ensure that they do not misbehave with any teacher and maintain appropriate and due conduct. With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
