Mr. Sarthak Burman, learned advocate appears on behalf of the writ petitioner and submits that writ petitioner was assistant teacher in Sarat Kumari Girls' High School, District- Nadia with effect from 15th February, 1996 in Geography and she was enjoying honours graduate scale of pay from the date of her appointment. The writ petitioner acquired postgraduate qualification of M.Sc in Geography on 31st August, 2010. On acquisition of such higher qualification writ petitioner approached the school authority of Sarat Kumari Girls' High School, District- Nadia, for sanction of postgraduate scale of pay which according to the petitioner was approved by the said school authority upon holing a Managing Committee meeting on 22nd November, 2011.

Thereafter, the Headmistress of the said school by

preferring the representation dated 16th April, 2012 approached the Additional District Inspector of Schools (S.E.), Ranaghat Sub-division, DistrictNadia, for sanction of postgraduate scale of pay. Unfortunately till date such application has not been decided by the concerned respondent authorities and the issue is kept pending.

This writ petition was taken up for hearing on 14th September, 2021 when accommodation was prayed for on behalf of Mr. Gourav Das, learned advocate, since he was not present in Court on last date. Today matter has been accommodated in the list pursuant to the order of this Court dated 14th September, 2021 but no one appears on behalf of the State respondents.

In view of the representation which has been preferred before the Additional District Inspector of Schools (S.E.), Ranaghat Sub-division, District- Nadia, page 28 of the writ petition, this Court directs the District Inspector of Schools (S.E.), Nadia, the respondent no.3, to take a decision on the representation dated April 16, 2012 seeking sanction of postgraduate scale of pay, within a period of twelve weeks from the date of communication of this order. The respondent no.3 is directed, if necessary, to call for the records from

the Office of the Additional District Inspector of Schools (S.E.), Ranaghat Sub-division, DistrictNadia, as well as from the school authority of Sarat Kumari Girls' High School, District- Nadia, prior to taking such decision. The respondent no.3 is also directed to grant opportunity of hearing to the writ petitioner and the school authority of Sarat Kumari Girls' High School and shall communicate his decision within two weeks thereafter.

With the above direction, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
