Mr. Robiul Islam Mr. Masooq Rahman ...for the petitioner Ms. Sulagna Bhattacharya Mr. Subrata Bhattacharjee ...for the State Petitioner claims to be the owner and occupier of a land being Plot No. 385, JL No. 84 under Mouza - Dakshin Gopalpur, in the district of Purba Medinipur. Petitioner states that adjacent to the property of the petitioner, plot no. 384 is situated wherein there is a culvert. Petitioner has submitted a representation dated December 9, 2025 before the Assistant Engineer, Panskura Highway Sub-Division, Public Works (Roads) Directorate praying for a grant of long term lease and/or settlement of the PWD land in front of the property of the petitioner and also to renovate the dilapidated culvert.

Learned advocate appearing for the petitioner submits that in spite of receipt of such representation, the respondent authorities have not

communicated their decision on such representation to the petitioner till date.

Ms. Bhattacharya, learned advocate appearing for the State submits that the application has not been filed in the prescribed format. She further submits that the petitioner has also not annexed relevant materials for the purpose of consideration of the prayer of the petitioner.

Without entering into the merits of the claims made by the petitioner in the representation dated December 9, 2025, this writ petition stands disposed of by directing the Assistant Engineer, Panskura Highway Sub-Division, PW(Roads) Directorate, being the 6th respondent herein, to consider the representation of the petitioner dated December 9, 2025 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner and any other person who may be affected by such decision or their authorized representative and to communicate the reasoned order to the petitioner as expeditiously as possible but positively within a period of four weeks from the date of receipt of a server copy of this order along with a copy of the representation of the petitioner dated December 9, 2025.

It will be open to the respondent no. 6 to call upon the petitioner to produce any relevant material that may be necessary for the purpose of taking a decision on the representation of the petitioner and upon being called upon to do so, the petitioner shall comply with such requisition forthwith.
