Counsel for the petitioner submits that the only ground on which the complaint has been lodged against the petitioner is that he was unable to accommodate his wife in his official quarter at Panagarh. This Court is unable to accept the same. This Court is notes that the petitioner has not cooperated with the investigation as recorded by the Sessions Judge, Bankura and as confirmed by the counsel for the State. Given the aforesaid conduct of the petitioner this Court is not inclined to interfere to grant relief under Section 438 CrPC and hence dismissed.
