The petitioner asserts that she is a co-sharer of a building located at 170, Keshab Chandra Sen Street, Kolkata-700009, Ward No. 37, Borough-V, under the jurisdiction of the Kolkata Municipal Corporation. She contends that respondent nos. 7 and 8, who are also cosharers of the property, have carried out unauthorised construction at the premises without obtaining the requisite approval from the Kolkata Municipal Corporation.

The Corporation has submitted a report in this regard. It has been brought to the Court's attention that the Corporation issued a demolition order on December 30, 2022. A partial demolition has already been carried

out; however, further demolition has been impeded due to the unavailability of police force.

In light of this, no further issues remain to be adjudicated in this writ petition. The Corporation is hereby authorised to complete the demolition work with the assistance of the Officer-in-Charge of Amherst Street Police Station. The Officer-in-Charge shall provide the necessary support to the Corporation to implement the demolition order.

Accordingly, WPA 3059 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
