Dilip Kumar Saha, learned counsel Court No. 22 03.8.2023 (Item No. 67) (AB) appearing for the petitioner submitted that, there are certain formal defects in the writ petition and the necessary party is also not impleaded, accordingly he prayed for leave to withdraw this writ petition and to file afresh on the self-same cause of action. Ms. Iti Dutta, learned advocate led by Mr.

Supriyo Chattopadhyay, learned Additional Government Pleader appeared for the State.

Considering the submissions made on behalf of the petitioner and considering that the petitioner is a retired Assistant Teacher, leave is granted to the petitioner to withdraw this writ petition and accordingly the same stands withdrawn with a leave to file afresh on the self-same cause of action. Accordingly, with the above leave this writ petition W.P.A. 1986 of 2018 stands dismissed as withdrawn.

It is made clear that, this Court has not gone into the merit of the claim of the writ petition in any manner.
