Das Mr. Balaram Patra Mr. Suvadip Bhattacharjee ...for the Petitioner Mr. Suman Ghosh Mr. Siddharta Ghosh ... for the State Mr. Rakesh Singh Ms. Trishani Sarkar ...for the Respondent No. 6 Petitioner is aggrieved by the fact that he approached the Officer-in-Charge, Serampore Police Station on 20th of January, 2025 requesting to register a General Diary against the management of Holy Home School, Serampore, District- Hooghly. According to the petitioner he was not provided with General Diary number and as such he has been compelled to approach this Court.

State has submitted a report. Report reflects that Serampore PS GDE No. 1952 dated 27.01.2025 has been registered with the concerned police station. It has been additionally prayed by the petitioner that

since there are directions of the Court the petitioner cannot be prevented and he would require police assistance for entering the school. Since the subject matter relating to his service is not within the domain of the police authorities if an appropriate Court of Law passes a direction, police authorities would render such assistance.

Learned Advocate for the respondent No. 6, the school management is present and submits that an appeal has been preferred and a copy of case status document is handed over which reflects the appeal to be pending.

In view of the limited scope to interfere with the prayers advanced I direct that in case the petitioner approaches further to the police station, the police authority would accept his information.

However, it would be the discretion of the police authorities to check before taking any action whether the information so furnished empowers them to act in a particular manner or not.

With the aforesaid observations WPA No.

3301 of 2025 stands disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.
