Petitioner refers to an order passed by the learned Civil Judge (Junior Division) 1st Court, Sealdah, wherein by an order dated 27.04.2023 the learned court was pleased to direct the defendant to handover a duplicate key for opening the padlock. Learned advocate appearing for the petitioner submits that the keys were handed over. But subsequently again the petitioner had been out for some days when a fresh padlock was fixed at the same place. Petitioner prays for interference by the police authorities.

Learned advocate for the private respondent no. 3 opposes the contentions.

Learned advocate for the state is present.

As the petitioner is already before a civil court and complains that the order of the civil court has been violated by forcefully creating a changed circumstance and not complying with the earlier order, I am of the view that the petitioner would approach the civil court with similar prayer. If such a prayer is advanced the learned court if it deems fit and proper subsequently, would pass necessary directions upon the police authorities.

With the aforesaid observations WPA 3098 of 2024 is disposed of.
