Copies of documents filed on behalf of the alleged contemnor/respondent no.5 are taken on record. It is submitted on behalf of the alleged contemnor that all the relevant documents were submitted before the concerned authorities on 13th November, 2019. However, after the passing of the order, the documents were not re-supplied to the respondent no.2. For this, the alleged contemnor renders unconditional apology. He wants to resubmit those documents before the respondent no.2, within a week from this date. The above facts about an alleged prior service were not brought to the notice of this Court by the said respondent no.5 at the time of hearing of the main matter as the respondent no.5 was not represented despite service of notice. Let the alleged contemnor place these and subsequent facts before this Court in the form of an affidavit, within two weeks from this date.

Copy shall be served upon the applicant/petitioner and the respondent no.2.

The petitioner shall also notify the respondent no.2 about the next date of hearing.

Counter, if any, be filed within a week from the date of service of such affidavit.

List this matter for further consideration under the same heading on 07th January, 2026 at 2pm.

The appearance of the alleged contemnor is noted and is dispensed with for the present.

However, this alleged contemnor shall remain present along with his learned advocate on the next date of hearing. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
