Mr. Sakti Pada Jana, Mr. Jaladhar Das, Mr. Subhajyoti Das ....for the petitioner Mr. Biswabrata Basu Mallick, Ms. Rajlakshmi Ghatak ...for the State The petitioner is aggrieved that despite refixation of pay scale by an order dated February 20, 2015, issued by the Commissioner of School Education, Government of West Bengal, the Additional District Inspector of Schools (SE), Kandi Sub-Division, Murshidabad, has withheld a sum of Rs. 64,513/- towards arrears between 1st April, 2008 to 31st March, 2015.

All other previous and subsequent arrears have been paid to the petitioner. The petitioner has made a representation dated January 13, 2020 to the Commissioner of School Education, which remains unconsidered.

The Commissioner of School Education shall, therefore, immediately upon receipt of a copy of this order and not later than a period of

three weeks thereof, consider the petitioner's claim for refund of the said sum of Rs. 65,513/- and also the reasons why the Additional District Inspector of Schools (SE), Kandi Sub-Division, Murshidabad has, in his order dated January 4, 2015, directed withholding of the said amount. In the event the Commissioner of School Education finds that the withholding of the said amount is incorrect, the same may be released to the petitioner immediately, without any further delay.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
