Case No. 172 of 2024 Dated 5.6.2024 under Section 20(b)(ii)(c) /29 of the NDPS Act And In the matter of : Mitul Sk. @ Mithul Sk.

......Petitioner.

Mr. J. I. Hossain .....for the Petitioner.

Mr. Antarikhya Basu, Ms. Mamata Jana ......for the State.

Dictated by Arijit Banerjee, J.

1.

The petitioner says that there was no recovery from him. He has been implicated solely on the basis of statements made by co-accused persons. Investigation is complete. Charge sheet has been filed. He is in custody for 50 days. He prays for bail.

2.

Opposing the prayer for bail, learned State Advocate points out that the petitioner was absconding. Charge sheet was filed showing him as absconder. He surrendered after his application for anticipatory bail was rejected. The Call Details Record shows exchange of phone calls between the petitioner and the principal accused. Commercial quantity of ganja is involved.

3.

In view of the prima facie involvement of the petitioner and the fact that he was absconding, we are not inclined to allow his prayer for bail, at this stage.

4.

The prayer for bail is rejected.

5.

CRM (NDPS) 202 of 2025 is dismissed.
