Learned counsel for the petitioner submits that the petitioner is the husband of the victim and is in custody for about 110 days. Charge sheet has been submitted. There is no prima facie material against him in respect of the offences alleged. Learned counsel for the State produces the Case Diary and opposes the prayer. Learned counsel submits that sufficient incriminating material has transpired against the petitioner from the statement of witnesses recorded under Section 164/161 of the Code of Criminal Procedure. Co-accused who are parents of the petitioner are still absconding after their prayer for anticipatory bail was turned down.

Upon consideration of the material available in the Case Diary as well extent of complicity of the petitioner in the offences alleged, prayer for bail is rejected at this stage.

The application for bail is disposed of.
