Mr. Dilip Kumar Samanta Mr. Biswapriya Samanta Mr. Debapriya Samanta Mr. Samrat Ghosh ...for the petitioner Mr. Anirban Ray Mr. Ayan Banerjee Mr. Supratim Dhar ...for the State The petitioner has approached this Court in the present writ petition on the basis of a newspaper clipping which demonstrates that 14 bighas of acquired land shall be utilised for the purpose of construction of a bus stand on the request of the local inhabitants. The petitioner submits that no notice of acquisition of the said land was served on him despite the fact that the petitioner is in occupation of 0.41 decimals of land in the said plot.
Learned counsel for the State-respondents submits a report which indicates that the respondent authority is not responsible for any newspaper clipping over the subject matter. There is no notification for acquisition of the plot in question and also no proposal for such acquisition. It is also recorded that in the event of such acquisition, proper notice shall be served to the landholders by the authority.
In view of the above, this Court is inclined to hold that there is no cause of action in the present writ petition which is liable to be disposed of.
Accordingly, this writ petition is disposed of. There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
