Statement of the victim is placed before us.
Bearing in mind the extent of complicity of the petitioner in the alleged crime in the light of the aforesaid statement, we are of the opinion that custodial interrogation of the petitioner for progress of investigation is not necessary and he may be granted anticipatory bail.
The learned Counsel for the petitioner has drawn our attention to two orders passed by the coordinate Benches in CRM No. 6010 of 2020 dated 4th December, 2020 and CRM No. 11299 of 2020 dated 31st December, 2020 where persons similarly placed as that of the petitioner/s in those cases have been granted anticipatory bail by the coordinate Benches. Accordingly, we direct that in the event of arrest, the petitioner, namely, Safi Sk. shall be released on anticipatory bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
The application for anticipatory bail is allowed.
