1. Appellant/convict is represented by the learned Advocate.

2. State is represented.

3. In pursuance of the direction passed by this Court dated 10.06.2025 a certificate issued by the Superintendent, Berhampore Central Correctional Home is handed over by the learned Advocate for the State during course of hearing.

4. It appears from the said certificate issued by the Superintendent, Berhampore Central Correctional Home that this convict had already served out the sentence as passed by the learned Trial Court in the impugned judgment and order of conviction and he was released on expiry of sentence on 27.10.2011 after getting 430 days remission.

5. The instant appeal was preferred at the behest of the appellant challenging the impugned judgment and order of conviction passed by the learned Trial Court dated 08.12.2005 and 09.12.2005 in connection Sessions Serial Case No. 52/03 corresponding to G.R. Case No. 544/95 arising out of

Bharatpur P.S. Case No. 53/95 dated 08.09.1995 under Section 376 of the Indian Penal Code.

6. The appellant had already served out the sentence. The judgment and order of conviction passed by the learned Trial Court is hereby affirmed.

7. The instant appeal be and the same is hereby dismissed.

8. Let the report submitted by the Superintendent, Berhampore Central Correctional Home be kept with the record.

9. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court immediately.

10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
