Although the petitioner and the private respondents are not represented, however, taking into consideration the fact that the writ petition has been filed for execution of demolition notice dated 4th January, 2012 for demolishing and removing the unauthorized construction raised by the respondent Nos. 7 to 10 at holding No. 103(Old P-86), National Place, Uttar Baksara, District-Howrah and further noting from the judgment and decree dated 13th August, 2024 that a suit had been filed by the private respondent Nos. 7 to 10 before the Court of learned Civil Judge(Junior Division), 6th Court, Howrah being title suit No. 89 of 2012 against the Howrah Municipal Corporation for a decree declaring and restraining the defendants from causing obstruction against the work of construction at schedule <A= property and the
WPA 3277 of 2026 learned Court by the aforesaid judgment and decree dated 13th August, 2024 having considered the scope of Section 177(3) of the HMC Act, had vacated the interim order of status quo and had disposed of the suit, I am of the view that unless there may be any impediment on the part of the municipality in implementing the notice of demolition dated 4th January, 2012, the same should be enforced in accordance with law within a period of three months form date, by issuing an intimation in this regard to the parties.
2. With the above observations and directions, the writ petition is disposed of.
