Learned advocate appearing for the petitioner submits that the petitioner is in custody in excess of one year. He draws the attention of the court to the statements recorded under section 164 of the Criminal Procedure Code. He also draws the attention of the court to the order dated December 7, 2020 passed in CRM 9902 of 2020 granting bail to one of the co-accused. State is represented.

The petitioner and his wife approached this Hon'ble Court for bail in CRM 9902 of 2020. Such bail petition was disposed of on December 7, 2020.

The Statements recorded under section 164 Criminal Procedure Code were considered on December 7, 2020. On consideration of the same, bail was granted in favour of one of the co-accused who is the wife of the petitioner. Prayer for bail made on behalf of the petitioner was rejected. Today, we find no

new material before us to take a different view than what was returned on December 7, 2020 by the co-ordinate Bench on the prayer for bail made by the petitioner.
