Ila Rani Pal & ORS v. Krishnagar Municipality & ORS
Item No.194 In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side 08.09.2023 Ct-24 AGM WPA 2362 of 2020 Ila Rani Pal & Ors.
v.
Krishnagar Municipality & Ors.
Mr. Atish Kumar Biswas ...For the petitioners.
Mr. Tapas Kumar Adhikari ... for the State.
Mr. Surya Prasad Chattopadhyay Mr. Arjun Sengupta ... For the Krishnanagar Municipality.
Heard submissions made on behalf of both the parties.
The Accountant, Krishnanagar is present personally before this Court.
The issue of calculation was discussed with the Accountant of the Municipality. It has been submitted that all dues of the petitioner have been paid and the interest on account of delayed payment has been calculated in the Simple Interest method.
The petitioner appears to be aggrieved by the same.
The Court is of the opinion that the Court not being an expert body to calculate the dues of a retired employee has to rely upon the calculation made by the competent authority.
In the instant case, the employer of the Municipality, through the accountant of the establishment, has made necessary calculation and the accountant of the Municipality is present in Court and submits that all payment has been made in accordance with the simple interest manner of calculation, as such there is no reason to disbelieve or disregard the said calculation.
Personal appearance of the Accountant, Krishnanagar Municipality is dispensed with.
The original calculation sheet signed by the Chairman, Krishnanagar Municipality dated 7th September, 2023 is handed over to the learned advocate appearing for the petitioner in Court today.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
